Mindtend Ltd ("Mindtend", "we", "us" or "our") is committed to protecting and respecting your privacy. This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you use our website and services. Mindtend operates solely as a technology platform that connects individuals with independent therapists. We do not provide therapeutic services ourselves, do not supervise or monitor therapy sessions, and do not access, store, or process clinical therapy records or personal health information exchanged between therapists and clients.

IMPORTANT DISCLAIMER

Mindtend provides no clinical services, advice, or supervision. All therapeutic services are provided independently by qualified therapists who maintain complete autonomy over their clinical practice. Mindtend accepts no responsibility for the quality, safety, or outcomes of therapeutic services, and users engage with therapists entirely at their own discretion and risk.

2. WHAT DATA WE COLLECT

We only collect data necessary to operate the Mindtend platform and connect users with therapists. This includes:

4. HOW WE USE YOUR INFORMATION

  • To operate, maintain and improve our website and services

  • To communicate with users and therapists (e.g. confirmations, reminders, material notices)
  • To uphold security, prevent fraud and abuse, and comply with legal requirements (e.g. financial recordkeeping)

We do not use therapy session data or messages exchanged between clients and therapists.

5. OUR ROLE VS. THERAPISTS’ ROLE

Mindtend as data controller: We are the data controller for platform operations including account management, therapist–client matching, booking facilitation, payment processing coordination, platform security, fraud prevention, essential service communications, and usage analytics. Our processing is limited to administrative and operational functions and does not extend to clinical data, therapeutic communications, or health information.

Therapists as independent controllers: Therapists listed on Mindtend operate independently and are separate data controllers for all personal data they process in the course of providing therapy services. This includes clinical records such as session notes, assessments, treatment plans, progress notes, and any health information. Therapists are solely responsible for:

  • Compliance with all applicable data protection laws regarding clinical data
  • Obtaining necessary consents for clinical data processing
  • Implementing appropriate security measures for clinical data
  • Handling data subject rights requests relating to clinical data
  • Reporting any data breaches involving clinical data to relevant authorities

Mindtend does not access, control, or have any responsibility for clinical data. For any data rights related to therapy records, please contact your therapist directly.

6. AUTOMATED SUGGESTIONS

We use limited automation to suggest therapists based on your stated preferences and availability. These suggestions do not produce legal or similarly significant effects. You always choose your therapist, and no booking is made without your action. If we ever introduce solely automated decisions with significant effects, we will notify you in advance and provide safeguards including human review, explanation, and the ability to contest the decision.

If you choose to provide therapy topics/areas (e.g. anxiety, depression), this may reveal or infer health information, which is sensitive under data protection law. We process such data only with your explicit consent, solely to provide matching, and we minimise what we store. You may withdraw consent at any time in your account or by emailing us; withdrawal does not affect prior lawful processing.

8. COOKIES & TRACKING TECHNOLOGIES

Mindtend uses cookies and similar technologies for:

  • Website functionality and performance
  • Analytics and service improvement
  • Preference saving (e.g., filters, language)

9. DATA SHARING

  • Independent therapists you choose to connect with via our platform

We do not sell or rent personal data to third parties.

10. INTERNATIONAL TRANSFERS

Where personal data is transferred outside the UK/EEA (for example, due to global content delivery or payment processing), we use lawful transfer tools such as adequacy regulations/decisions, appropriate safeguards (e.g., Standard Contractual Clauses, the UK International Data Transfer Agreement or the UK Addendum), supported by transfer risk assessments where required. We apply additional safeguards as appropriate.

11. SECURITY

We take appropriate technical and organisational measures to protect your personal data, including:

  • Access controls (least privilege) and monitoring; MFA for administrative access
  • Secure infrastructure, change control, and vulnerability management
  • Audit logging, rate limiting, bot/threat detection, and file quarantine for suspicious uploads

No online system is completely secure. Please use strong, unique passwords and avoid sharing sensitive data on public devices.

12. DATA RETENTION

We retain personal data only as long as necessary, then delete or anonymise it. Typical retention periods are:

14. MARKETING

We send essential service communications related to your account and bookings.

Clients: we rely on consent (or soft opt-in where permitted) for marketing emails/SMS; you can opt out at any time using the unsubscribe link or account settings.

Therapists: we may contact you for professional outreach on the basis of legitimate interests; you can opt out at any time. Electronic marketing complies with applicable regulations.

15. CHILDREN'S PRIVACY

Mindtend is for individuals 18+. We do not knowingly collect data from individuals under the age of 18. If you believe we have inadvertently collected data from a minor, please contact us.

16. COMPLAINTS

If you are unhappy with how we process your data, please email privacy@mind-tend.com and we’ll do our best to help. You also have the right to lodge a complaint with the Information Commissioner’s Office (ICO): https://ico.org.uk.

11. CHANGES TO THIS POLICY

We may update this policy. Material changes will be notified by email or via the website. The latest version is always available on our site.

This policy reflects Mindtend's role as a facilitator only. All therapy services are conducted privately and independently between therapists and clients. Mindtend does not monitor or access therapy sessions or communications.
